Please read these Terms of Service ("Terms") carefully before using the LocShare mobile application ("the App," "LocShare," "we," "us," or "our"). By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
You must be at least 13 years old to create an account or use LocShare. By using the App, you represent and warrant that you meet this age requirement.
LocShare is not directed at children, and we do not knowingly permit use by anyone under the required minimum age. If we become aware that an underage individual has created an account, we will take steps to remove that account.
LocShare is a location-sharing application that allows users to share their real-time location with contacts they choose, discover and connect with new people through mutual connections and shared interests, and use related features including but not limited to messaging, activity-based challenges, and location history tracking. Features and functionality may change over time, and we may add, modify, or remove features at our discretion.
You must register using a valid phone number and complete phone verification to use LocShare. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. You agree to provide accurate information and to keep it up to date.
LocShare does not share your location with any other user by default. You control who can see your location through settings including per-contact sharing permissions and time-limited or persistent "Go Live" broadcasts that you initiate. You may stop sharing your location at any time, including through "Ghost Mode," which disables active location broadcasting.
You are solely responsible for your decisions about who you share your location with. LocShare provides the tools to control sharing, but cannot guarantee the conduct of other users once you have chosen to share your location with them.
You agree not to:
LocShare may facilitate connections with people you do not already know, including through mutual-connection and interest-based discovery features. LocShare does not conduct criminal background checks or independently verify the identity, age, or intentions of users. You are solely responsible for exercising caution and good judgment in all interactions with other users, whether online or in person.
If you choose to meet another user in person, we strongly recommend meeting in a public place, telling a friend or family member where you are going, and using your own independent judgment about your safety. LocShare is not responsible for the conduct of any user, on or off the App, and disclaims liability for any injury, loss, or damage arising from interactions between users, to the fullest extent permitted by law.
You retain ownership of content you submit through the App (messages, custom tags, photos, etc.), but grant LocShare a non-exclusive, worldwide, royalty-free license to host, store, and display that content as necessary to operate the App. You are solely responsible for content you submit and represent that you have the right to share it.
We reserve the right, but not the obligation, to review, moderate, or remove content that violates these Terms or our content policies, including through automated filtering and user reporting mechanisms.
LocShare provides tools to block and report other users. We take reports seriously and will review them, but we do not guarantee a specific outcome, timeline, or that we will take any particular action in response to a report.
Our collection and use of your information is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the data practices described there.
The App, including its design, features, graphics, and underlying technology, is owned by LocShare and protected by applicable intellectual property laws. These Terms do not grant you any rights to LocShare's trademarks, logos, or brand assets except as necessary to use the App as intended.
You may stop using the App and delete your account at any time. We may suspend or terminate your access to the App at our discretion, including for violation of these Terms, fraudulent activity, or conduct that we believe poses a risk to other users or the App itself.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT LOCATION DATA WILL BE ACCURATE AT ALL TIMES.
TO THE FULLEST EXTENT PERMITTED BY LAW, LOCSHARE AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE APP, ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP, OR ANY INTERACTIONS BETWEEN USERS, WHETHER ONLINE OR IN PERSON.
You agree to indemnify and hold harmless LocShare and its owners, employees, and contractors from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the App, your violation of these Terms, or your interactions with other users.
These Terms are governed by the laws of Maryland, without regard to conflict of law principles.
We may update these Terms from time to time. If we make material changes, we will provide notice (such as an in-app notification or updated "Last updated" date). Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
